General terms and conditions
1. scope of application
The business relationship between the customer and Drinks & More GmbH & Co. KG shall be governed exclusively by the following General Terms and Conditions for ordering in the Drinks & More Online Shop(www.ready2drink.de) as amended from time to time.
2 Conclusion of contract
2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking the "Buy" button, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of your order, together with acceptance of the order, is sent immediately after sending by automated e-mail. With this order confirmation or by delivery of the goods within seven days, the purchase contract is concluded.
2.2 Drinks & More is free not to accept online orders. If Drinks & More does not fulfil an order, Drinks & More will inform the customer immediately.
2.3 Deliveries are only possible within Germany.
2.4 By placing an order, the customer confirms that he/she is 18 years old.

To provide our offers and process our orders, we use the Shopify platform https://www.shopify.de/). The customer needs a Shopify account to place an order. For this account, only the AGB and the Privacy policy of Shopify.
4. right of withdrawal / exclusion of right of withdrawal
4.1 If the customer is a consumer, he/she is entitled to a right of withdrawal with regard to all items purchased in our shop. The details and the requirements for the return can be found under the item right of withdrawal in item 5.
4.2 Entrepreneurs are not granted a voluntary right of withdrawal.
5. right of withdrawal
5.1 Cancellation policy
You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.
To exercise your right of withdrawal, you must notify us(Drinks & More GmbH & Co. KG, Hagener Straße 261, 57223 Kreuztal Tel.: 02732 8808864, e-mail: service@drinks-and-more.com) by means of a clear declaration (e.g. a letter sent by post, e-mail) about your decision to revoke this contract. You can use the withdrawal form for this purpose, which is, however, not mandatory. The withdrawal form can be found on the website or requested directly from the Customer Care Team at service@drinks-and-more.com . To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
5.2 Consequences of revocation
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. However, this does not apply until we have received the goods back from you or you can prove that you have sent them back (for example, with a delivery receipt from the parcel service). If you have not yet paid for the goods, you do not have to pay the purchase price of the revoked purchase contract from the time of revocation.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

6. delivery / shipping costs
6.1 Lieferungen sind nur innerhalb Deutschlands möglich. Die Lieferung erfolgt generell über die Deutsche Post AG, Charles-de-Gaulle-Straße 20, 53113 Bonn, und zwar innerhalb von ca. 3 – 5 Werktagen nach Bestelleingang, sofern nicht auf der Produktdetailseite anders angegeben. Sofern uns Ihre gültige E-Mail-Adresse vorliegt, werden wir Sie über den Versand Ihres Paketes informieren und Ihnen die Sendungsnummer zur Verfügung stellen. Mit Hilfe der Sendungsnummer können Sie auf der Website der Deutsche Post AG (https://www.dhl.de/de/paket/information/sendungsverfolgung.html) den Status Ihrer Sendung entnehmen. Zudem werden wir Ihre E-Mail-Adresse an die Deutsche Post AG weiterleiten, damit Sie die Ankündigung Ihres Pakets erhalten.
6.2. Die Porto- und Versandkosten pro Auftrag betragen pauschal 6,90 Euro. Ab einem Warenkauf über 30 Euro ist der Versand kostenlos.
7 Warranty, transport damage
7.1 The warranty shall be governed by the statutory provisions.
7.2 The following applies to consumers: If goods are delivered with obvious transport damage, please complain about such defects to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to be able to assert our own claims against the carrier or transport insurance.
8. prices / use of Drinks & More
The prices stated at the time of ordering apply. All prices in the online shop are Euro prices including the statutory value added tax.
9. payment
The customer pays in the way that is most convenient for him/her. We offer the customer various methods of payment as listed below.
By credit card:
We accept payment by credit card (VISA, and Euro- / Mastercard). When ordering with a credit card payment, the customer is kindly requested to directly provide his/her 16-digit card number, the security code and the expiry date. Your credit card account will be charged upon completion of the order.
Via PayPal:
In the case of a PayPal payment, you will be automatically redirected to the PayPal payment service after completing the order process. The payment process is then governed by the PayPal terms and conditions.
10. retention of title
The goods remain the property of Dinks & More until payment has been made in full.
11. set-off / right of retention
11.1 The customer has the right of set-off only if his/her counterclaims have been legally established or recognised by Drinks & More.
11.2 The customer is entitled to exercise a right of retention if the counterclaim is based on the same contractual relationship.
12. online dispute participation platform
The European Commission provides a platform for online dispute resolution (ODR platform) at the link http://ec.europa.eu/consumers/odr link. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
